Asset curatorship regime for minors in Ecuador: legal foundations and limitations in its implementation

The curatorship of assets for minors constitutes an essential legal mechanism for the protection of property in contexts of legal incapacity. The objective of this study was to examine the structural weaknesses of the system of asset curatorship for minors in Ecuador. To this end, a qualitative approach was employed, based on a doctrinal and legal-normative design. A review of primary legal sources, specialized doctrine, and relevant case law was conducted through interpretative and thematic analysis. The study revealed that, although the legal framework establishes clear functions, responsibilities, and restrictions for the curator, there are gaps in terms of institutional oversight, training, and supervision mechanisms. Case law shows a tendency to expand the scope of curatorship, incorporating psychosocial criteria into the protection of the minor. Structural weaknesses were identified in the implementation of the system, particularly in oversight and the training of curators. In response, a training program is proposed to strengthen technical and ethical competencies, contributing to more efficient, transparent management aligned with the principle of the best interests of the child.
